Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (“you”, “Customer”) and [LEGAL_ENTITY_NAME] (“Staying API”, “we”, “us”), governing your access to and use of the Staying API REST API, MCP server, dashboard, website, and related documentation (together, the “Service”). By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Staying API provides programmatic access to publicly available Airbnb stay data through a stable REST API and an MCP (Model Context Protocol) server. We expose listings, photos, host information, reviews, availability, and pricing as structured data. We do not provide access to Airbnb’s internal systems and hold no Airbnb credentials; see Trademark and affiliation.
2. Accounts and API keys
You must provide accurate account information and keep your credentials secure. You are responsible for all activity that occurs under your account and API keys, including activity by your end users and downstream applications. Notify us promptly at support@stayingapi.com if you suspect unauthorized use. You must be at least the age of majority in [JURISDICTION] to use the Service.
3. Acceptable use
You agree not to, and not to permit any third party to:
- exceed, circumvent, or attempt to circumvent rate limits, credit allotments, authentication, or other technical controls;
- resell, sublicense, or redistribute raw Service responses as a substantially similar competing data API or bulk dataset, except as expressly permitted in a separate written agreement;
- use the Service to violate the rights of any third party, including the intellectual property, privacy, or contractual rights of property owners, hosts, guests, or Airbnb, Inc.;
- use the Service in any way that is unlawful in [JURISDICTION] or in the jurisdiction where you operate, or to facilitate harassment, discrimination, stalking, or surveillance of individuals;
- attempt to probe, scan, overload, disrupt, or reverse-engineer the Service or its underlying infrastructure, except to the extent that restriction is prohibited by applicable law.
You are solely responsible for ensuring your own use of the data complies with applicable law and any third-party terms that apply to you.
4. Rate limits and fair use
Access is subject to per-plan rate limits and per-endpoint caps published in the pricing and product documentation. We may apply reasonable technical limits to protect the stability of the Service and may throttle, queue, or temporarily suspend requests that materially exceed your plan’s limits. We will make a commercially reasonable effort to give notice before imposing new limits that would materially reduce a paid plan’s existing allotment.
5. Billing and credits
Paid plans and usage-based credits are billed as described at pricing and at checkout. Unless stated otherwise:
- fees are stated in [CURRENCY] and are exclusive of taxes, which you are responsible for paying;
- subscription fees are billed in advance and credits are consumed as you make API calls;
- charges are non-refundable except where required by law or expressly stated;
- we may change pricing on a prospective basis with at least [NOTICE_PERIOD] notice; changes do not affect the current paid billing period already invoiced.
Failure to pay may result in suspension or termination of access. You authorize us and our payment processor to charge your designated payment method for all fees incurred.
6. Data accuracy and availability disclaimer
The Service is provided on an “as is” and “as available” basis. The data we expose is derived from publicly visible sources and may be incomplete, delayed, or inaccurate. We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose, and we make no warranty regarding the accuracy, completeness, or timeliness of any data. You should independently verify any data before relying on it for a decision with legal, financial, or safety consequences. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or the Service. Our total aggregate liability arising out of or relating to these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the [LIABILITY_CAP_PERIOD, e.g. twelve (12) months] preceding the event giving rise to the claim, or (b) [LIABILITY_FLOOR_AMOUNT, e.g. USD 100]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Intellectual property
We retain all rights in the Service, our software, brand, and documentation. Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Service and use the data it returns within your applications. The “Staying API” name and mark are ours; Airbnb and other marks are the property of their respective owners.
9. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal risk or threatens the stability or security of the Service. We will use reasonable efforts to give notice where practicable. Upon termination, your right to access the Service ceases; sections that by their nature should survive (including 6, 7, 8, 10, and 11) will survive.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and take reasonable steps to notify you, for example by email or an in-product notice. Your continued use of the Service after changes take effect constitutes acceptance.
11. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules. The courts located in [VENUE] will have exclusive jurisdiction over any dispute, unless a binding arbitration or alternative dispute-resolution clause is added here after legal review: [DISPUTE_RESOLUTION_CLAUSE].
